Booking rules of JSC Sanatorium Magadan
- These Rules of the sanatorium regime of JSC Sanatorium Magadan have been developed on the basis of Order No. 279n of the Ministry of Health of the Russian Federation dated 05.05.2016 «On Approval of the Procedure for organizing sanatorium treatment», Order No. 321n of the Ministry of Health of the Russian Federation dated 07.06.2018 «On approval of lists of medical indications and contraindications for sanatorium treatment» and other regulatory documents.legal acts and documents related to the organization of sanatorium treatment on the basis of the Civil Code of the Russian Federation , in accordance with Article 39.1 of the Law of the Russian Federation «On Consumer Protection», and Article 3.1 of the Federal Law «On the Basics of Tourism activities in the Russian Federation», in accordance with the Decree of the Government of the Russian Federation dated November 18, 2020 No. 1853 «On approval of the rules for the provision of hotel services in the Russian Federation».
- When performing actions to make a request for booking a voucher for sanatorium treatment and beds / rooms, or directly when making a settlement in a room at the Reception and Accommodation Service, the Customer confirms that he is familiar with these Rules of accommodation and booking, Fire safety Rules, as well as agrees with the terms of provision of paid services, gives consent to the processing of personal data in accordance with clause 4 of Article 9 of the Federal Law «On Personal Data» dated 07/27/2006 No. 152-FZ by providing a document, an identity document or other document (the list is defined in the Decree of the Government of the Russian Federation dated 09.10.2015 No. 1085).
These Rules, as well as Price Lists for sanatorium vouchers approved by the Contractor, are a public offer of JSC Sanatorium Magadan to an unlimited number of Customers interested in purchasing sanatorium services. Before concluding the contract, the Customer independently familiarizes himself with these Rules, posted in the Reception and Accommodation Service and on the page of the official website of the Sanatorium.
The Customer accepts the Public Offer by:
- payment of funds to the cashier or to the settlement account of the sanatorium;
- booking confirmation.
- Sanatorium-resort services (meals, accommodation, treatment) are provided by the Sanatorium on a paid basis to an unlimited number of people without any discrimination.
- Booking of vouchers for sanatorium treatment and beds/rooms is made within the current calendar year. Room reservations for the next calendar year are made after the approval of the price list of services.
- Booking (pre-booking) of a room can be carried out by sending a corresponding request in writing by mail, electronic communication or orally by phone.
The booking request must contain the following information:
- full name of the vacationers;
- the type and number of the document certifying the identity of the vacationer;
- date of arrival and departure (duration of stay);
- the number of people visiting (Vacationers);
- the number and category of accommodation rooms, indicating the type of bed (main, additional);
- the program of treatment of the vacationer (determined in accordance with the information posted on the official website of the Sanatorium, or specified by the sales department managers);
- customer's contact details (full name (for individuals) / name and TIN of the organization (for legal entities), phone number, e-mail address);
- other additional information (if necessary), which is of a preferred nature and is taken into account by the Contractor in case it is actually possible to ensure the desired conditions of the Customer. This may include the number of floors of the room, the indication of the building, the view from the windows of the room, additional services, etc.
- In case of failure by the customer to provide the information specified in clause 5. of these Rules, the application for booking a room is considered incomplete and the Sanatorium reserves the right to refuse to confirm the reservation unilaterally.
- The sanatorium confirms the booking request only if there are available beds/rooms of the requested category. The sanatorium confirms or refuses to satisfy the request for a room reservation within 72 hours from the moment of its receipt.
In case of confirmation of the booking request, the Sanatorium sends the customer an invoice for the payment of services, as well as a written form confirming the reservation of the room, by e-mail or via a connected messenger.
When booking, the Sanatorium independently determines for Customers the room corresponding to the category of accommodation specified in the application, based on the load and rational use of the room stock. When booking, the Customer has the right to state special wishes for the choice of a room (a specific building, room, floor, view from the window, etc.). Special wishes of the Customer are taken into account only if they can be fulfilled and are considered valid upon confirmation by the manager. If special requests are indicated in the comments when booking a room online on the official website, but their fulfillment is not confirmed by the manager, these requests are considered not taken into account by the Sanatorium and the Customer is deprived of the right to refer to them upon check-in.
If no special requests were indicated in the booking request and this request was confirmed by the Sanatorium, and the Customer agreed to this confirmation by making a payment, then it is considered that the booking of the room was carried out without imposing any obligations on the Sanatorium to take into account the special wishes of the Customer.
- The Sanatorium has a guaranteed room reservation rule regardless of the applicable rate. The reservation is considered guaranteed only after making an advance payment of 50% within 5 days from the moment of confirming the reservation request and invoicing for payment.
- With guaranteed booking, the voucher for sanatorium treatment and beds / rooms is reserved for the Customer within one day from the date of arrival. If you are late, the cost of the voucher for unused days is not reimbursed, the period of the voucher is not postponed, the voucher is not divided.
- When booking by the Customer (legal entity) or an individual entrepreneur, the amount and timing of the advance payment, cancellation conditions and other conditions are subject to application by the Contractor in accordance with the agreement concluded with the Customer and may differ from those specified in these Rules.
- An advance payment of 50% must be made by the customer within 5 days after confirming the reservation and invoicing for payment. In case of sale of vouchers within the framework of seasonal offers or with the use of a discount, the prepayment period may be reduced, the specific payment period is reported at the time of booking.
Until the payment is received, the reservation is considered preliminary and is automatically withdrawn without notifying the customer in the absence of a fee within the prescribed period of 5 days from the date of invoice.
- The reservation can be cancelled at the initiative of the customer, or at the initiative of the sanatorium.
The cancellation of the application is carried out by the Contractor by accepting the cancellation of the reservation from the Customer by mail, telephone or other communication, which allows it to be reliably established that the cancellation of the reservation comes directly from the Customer.
In case of cancellation of the reservation and refusal to check in to the sanatorium, the refund of funds for the prepaid cost of the voucher is carried out by the Sanatorium as follows:
- in case of cancellation of the reservation 7 days or less before the date of arrival, the refund is carried out minus the lost profit and compensation for direct costs associated with the organization of the Customer's reception and downtime of the room (room space), calculated based on the full cost of one day of the tour;
- if the reservation is cancelled more than 7 days before the date of arrival, the prepayment will be refunded in full.
If you refuse to check in on a voucher purchased under the promotion (purchased with a discount 7 days or less before the date of arrival), no refund will be made for unused days.
In the presence of documented valid reasons (deterioration of health in case of chronic illness of the Customer, death or illness of close relatives, the Sanatorium provides a refund completely regardless of the cancellation period.
The procedure for refusal of Sanatorium services and refund of funds for unused services is regulated by a separate regulation in force at the Sanatorium.
